X-PRESS PYXIS

The 2024- built fully cellular containership X-PRESS PYXIS suffered a stern tube failure on the 29th August 2024. The incident rendered her immobilised her and resulted in her drifting off the north-east coast of Japan.
As a result, the Owners had to arrange for the X-PRESS PYXIS to be towed to Yokohama where she has now arrived. It would appear that following on from inspections the X-PRESS PYXIS now requires permanent repairs which she will undertake at a drydock in northern China.
At the time of the incident, the X-PRESS PYXIS was laden with about 6,000 containers and sailing from Busan, South Korea to Yokohama, Japan and thereafter Canadian discharge ports.
As we understand the Shipowners are looking to discharge all cargo for transhipment and delivery to their original intended discharge ports in Canada.
As a result of this incident, the Owners have declared General Average and we represent part-cargo laden on board the X-PRESS PYXIS at the time of the incident. We are actively investigating the cause of the stern tube failure and have appointed a technical Hull and Machinery expert to attend on board the X-PRESS PYXIS to investigate the cause of the mechanical failure.
AMIS WISDOM III

The 2011-built bulk carrier suffered a grounding on a soft bank on 21 August 2024 whilst navigating the Amazon delta.
The vessel was subsequently refloated with the assistance of several salvage tugs, and favourable tide conditions. Following her refloating, she proceeded to the Fazendinha Anchorage for underwater inspections.
At the time of the incident, the vessel was proceeding on a fully laden voyage from Brazilian loading ports to discharge ports in Costa Rica and El Salvador.
As a result of this incident, the Owners have declared General Average. We have been instructed on behalf of part cargo onboard the vessel, and have engaged an expert to assist in our investigations into causation.
MAERSK FRANKFURT

The 2024-built fully cellular containership MAERSK FRANKFURT suffered a significant cargo fire hold on the 19th July 2024. At the time of the fire, the MAERSK FRANKFURT was approximately 100 nautical miles off the coast of India.
Several Indian coastguard vessels were deployed to the MAERSK FRANKFURT to assist, alongside several helicopters. However, firefighting operations were complicated by local weather as well as hazardous cargoes onboard the vessel.
In light of the fire, Smit Salvage was appointed as salvors under an Lloyd’s Open Form contract. The Owners additionally declared General Average and appointed Richards Hogg Lindley as GA Adjusters.
At the time of the fire, the MAERSK FRANKFURT was proceeding from South East Asian and Indian loading ports to Colombo, Sri Lanka. She had previously called at Malaysian and Chinese loading ports.
We represent part cargo that was laden onboard the vessel at the time of the incident, and are currently defending the LOF salvage and General Average claims. At the present time, we are actively investigating the cause of the fire and have appointed experts to assist in this regard.
NORTHERN JUVENILE

The 8,411 TEU fully cellular containership NORTHERN JUVENILE suffered a fire in her cargo hold on 26 May 2024. At the time of the fire, the NORTHERN JUVENILE was navigating the Indian Ocean off the coast of Malaysia.
After initial firefighting efforts by the crew, a significant cargo fire continued for several weeks causing considerable damage in her cargo holds.
In light of the fire, Smit Salvage was appointed to assist the vessel under a LOF contract. The Owners have further declared General Average and appointed Richards Hogg Lindley as GA Adjusters.
At the time of the fire, the NORTHERN JUVENILE was proceeding on a fully laden voyage from Singapore and Chinese load ports to West African discharge ports.
We represent part cargo that was laden onboard the vessel at the time of the incident, and are currently defending the LOF salvage and General Average claims. At the present time, we are actively investigating the cause of the fire and have appointed experts to assist in this regard.
LODUR

The 3,091 TEU fully cellular containership LODUR ran aground on the 16 May 2024. At the time of the grounding, the vessel was navigating waters off Freetown Sierra Leone.
The vessel suffered significant damage as a result of the grounding and attempts to refloat the vessel under her own steam were unsuccessful. Underwater inspections of the vessel indicate that the vessel was aground on rocks and that four of the vessel’s tanks were been breached.
In light of the grounding, T&T Salvage was appointed as salvors under a Lloyd’s Open Form contract. The Owners additionally declared General Average and appointed Stichling Hahn Hilbrich as GA Adjusters.
At the time of the grounding, the LODUR was proceeding on a circular voyage from Spanish and North African loading ports to West African discharge ports.
We represent part cargo that was laden onboard the vessel at the time of the incident, and are currently defending the LOF salvage and General Average claims. At the present time, we are actively investigating the circumstances surrounding the grounding and have appointed experts to assist in this regard.
HE ZHONG 2

The 2016-built chemical tanker HE ZHONG 2 suffered tailshaft damage and lost power on 20 April 2024 at Nanco Dangerous Goods Anchorage, China.
The Owners of the HE ZHONG 2 then declared General Average and appointed the China Council for the Promotion of International Trade as the General Average Adjusters.
At the time of the incident, the HE ZHONG 2 was proceeding on a laden voyage carrying isononanoic acid cargo between Chiba, Japan and China.
We represent cargo that was part laden on board the vessel at the time of the incident. At the present time we are actively investigating the cause of the incident.
DALI

Nature of Claim: | General Average |
On the 26th March 2024 the fully cellular containership DALI allided with the Francis Scott Key Bridge shortly after departure from the port of Baltimore. As a result of the allision, the bridge collapsed into the river below. Sadly, there were a number of casualties arising as a result of the allision. At the time of the incident, the DALI was proceeding on a laden voyage from US ports to Asian discharge ports.
The vessel’s allision with the pillar of the Francis Scott Key Bridge and subsequent bridge collapse rendered the vessel trapped by debris. In addition to this, a number of containers and cargo on the bow of the vessel were damaged.
At least 130 containers and cargo were damaged directly by the collapse of the bridge. It is reported that she was carrying some 4,700 cargo containers at the time of the allision. We further understand that some of the containers have been breached.
As of the 16th April a large salvage operation is ongoing. A number of salvage resources have been mobilised to free the vessel from the collapsed bridge and to clear the waterway for further maritime traffic. This has entailed the deployment of at least twelve floating cranes, including the Donjon-owned CHESAPEAKE 1000 which is the largest floating crane on the East Coast. It is further reported that Resolve Maritime has been engaged to support the salvage efforts.
The Owners of the DALI declared General Average on 12 April 2024 and in this respect GA security will have to be provided to secure the release of cargo. The Owners have further set up a USD 43.7 million limitation fund in the Federal Court in Maryland.
We have been instructed by part cargo that was laden onboard the vessel at the time of the incident. At the present time, we are arranging security for clients and have commenced investigations into causation.
XIN HAI TONG 9

The 2015-built bulk carrier XIN HAI TONG 9 suffered a main engine failure on 10 March 2024 off the coast of Algeria. The condition of the engine subsequently deteriorated rendering the vessel immobilised, and she began to drift towards the Algerian coast.
The Owners of the XIN HAI TONG 9 entered into a towage contract and as such a tug was dispatched, which deployed a line and towed the vessel to the port of Oran, Algeria for repairs. General Average was declared as a result of the incident.
At the time of the incident, the XIN HAI TONG 9 was proceeding on a fully laden voyage carrying steel cargo between loading ports in South Korea and discharge ports of Sagunto, Spain and Liverpool, UK.
We represent cargo that was laden on board the vessel at the time of the incident. At the present time we are actively investigating the cause of the incident.
ISLANDER

On 22 February 2024, whilst proceeding on a laden voyage from Thailand to Egypt, the M/V ISLANDER was struck by a drone missile within the Gulf of Aden, as a result of which a fire broke out, which was subsequently extinguished by the crew members.
The vessel was then diverted by her own means to Djibouti. Shipowners are unable to effect necessary repairs in Djibouti for the safe prosecution of the voyage, so they are actively looking into alternative solutions.
We represent part cargo that was laden on board the vessel at the time of the incident. At the present time we are representing clients’ interest as best possible to ensure cargo can be delivered swiftly and without further issues as well as to ensure potential recovery rights are protected.

On or about the 2nd February 2024, whilst proceeding on a laden voyage from Argentina to Irish/Northern Irish Ports, the FILIA suffered an incident with the rudder being offset following possible ground contact.
Repairs were swiftly completed and the vessel resumed her voyage towards discharge ports. As a result, the Owners of the FILIA declared General Average and appointed GA Adjusters to collect GA security and thereafter draw up the GA Adjustment.
We represent cargo that was laden on board the vessel at the time of the incident. At the present time we are actively investigating the cause of the incident.
JI HANG 15

The 2008-built general cargo ship JI HANG 15 suffered a main engine failure on 1 February 2024 whilst proceeding on a fully laden voyage between Jintang, China and Pohang, South Korea. At the time of this breakdown, it would appear that the vessel was navigating in boisterous weather and rough seas.
This engine failure rendered the vessel immobilised. As a result, the Owners of the JI HANG 15 organised the towage of the vessel to Weihei, China as a port of refuge. The Owners subsequently declared General Average.
We are instructed by part-cargo interests laden on board the vessel at the time of the incident and we are actively investigating the cause of the main engine breakdown

The 2009-built coal carrier AP DRIZIC suffered a main engine failure on 16 December whilst proceeding on a laden voyage between loading ports in South Sumatra, Indonesia and Karaikal, India after an intermediate call in Singapore.
The engine failure rendered the vessel immobilized and drifting off the coast of Sri Lanka. As a result, the Owners of the AP DRZIC entered into a Towcon contract for the vessel to be towed to the port of Hambantota, Sri Lanka, for repairs. The Owners subsequently declared General Average.
We are instructed by cargo interests laden on board the vessel at the time of the incident and we are actively investigating the cause of the main engine breakdown.
OOSTZEE

The 2008-built inland chemical tanker OOSTZEE suffered a grounding on 6 December whilst proceeding on a laden voyage between Antwerp, Belgium and Speyer, Germany along the Rhine. The grounding temporarily blocked the navigation channel on the Rhine.
The vessel was successfully refloated and proceeded to a safe port in Antwerp for repairs. The cargo was transhipped to its destination for discharge to receivers. The Owners subsequently declared General Average.
We are instructed by cargo interests laden on board the vessel at the time of the incident and we are actively investigating the cause of the main engine breakdown.
MARCO POLO

The 1993-built Ro-Ro passenger and cargo ferry MARCO POLO ran aground off Karlshamn, Sweden on 22 October 2023 whilst proceeding from Trelleborg, Sweden to Klaipeda, Lithuania.
It would appear that the vessel initially scraped her hull across a reef, which may have caused significant damage, before she ran hard aground. We further understand that the grounding may have caused a hull breach, and bunker fuel was reported in the water surrounding the vessel.
Smit Salvage were engaged to render salvage assistance under the provisions of Lloyd’s Open Form salvage contract. Following on from the salvors’ intervention, the vessel was successfully refloated and towed to a safe anchorage for initial inspections and temporary repairs. The vessel has since been towed to a shipyard in Gdansk, Poland for substantial repairs.
We represent part-cargo laden on board at the time of the incident and we are presently investigating the cause of the grounding.
SUPER G

On or about the 7th November 2023, whilst proceeding on a laden voyage to Jeddah, Saudi Arabia, the SUPER G suffered a main engine failure on account of its No2 H.P. F.O pump roller guide failing.
The crew were unable to restart the main engine and so the Owners of the SUPER G engaged the assistance of a salvage tug to tow the vessel to Jeddah for delivery of cargo and to undergo repairs.
As a result, the Owners of the SUPER G declared General Average and appointed GA Adjusters to collect GA security and thereafter draw up the GA Adjustment.
We represent part-cargo that was laden on board the vessel at the time of the incident. At the present time we are actively investigating the cause of the incident.
SOPHIA Z

Nature of Claim: | Common Law Salvage Claim and Salvage Indemnity Claim |
The 2009-built bulk carrier SOPHIA Z suffered a steering gear failure whilst transiting the Istanbul Strait on the 14th October 2023. As a result, the SOPHIA Z was immobilised and required salvage assistance.
Therefore, several tugs were deployed to make fast to the SOPHIA Z to tow her and her cargo to a place of safety. The Owners of the salvage tugs claimed common law salvage for the salvage services rendered. Upon arrival at Istanbul anchorage, the vessel’s steering gear was repaired and the SOPHIA Z was able to continue on her intended voyage.
At the time of the incident, the vessel was proceeding on a laden voyage from Varna in Bulgaria to Barcelona in Spain.
We represent all the cargo laden on board at the time of the incident. The salvage claim has now been settled and we are presently investigating the cause of the steering gear failure.
STARSHIP

On the 27th September 2023, the Chemical Tanker STARSHIP suffered a main engine breakdown whilst proceeding on a laden voyage from Tarahan, Indonesia to Manila, Philippines. The crew were unable to effect repairs and as such the STARSHIP was taken in tow to a nearby shipyard for repairs.
Upon arrival at the repair yard, a transhipment of cargo was arranged so that cargo could be delivered to Manila, Philippines without delay.
As a result of the incident, the Owners of the STARSHIP declared General Average and the GA Adjusters have now been appointed.
We represent all cargo laden on board the STARSHIP at the time of the incident and we are presently investigating the cause of the incident which gave rise to the declaration of General Average.
GULF DEFFI

The GULF DEFFI was proceeding on a laden voyage from Saudi Arabia to Korea when, on or around the 19th July 2023, she suffered water ingress and flooding to the engine room off the coast of China.
As a result, the Owners of the GULF DEFFI immediately engaged professional salvors to render salvage assistance to the GULF DEFFI and her cargo. Professional salvors agreed to salve the GULF DEFFI and her cargo under the provisions of Lloyd’s Open Form salvage contract and immediately despatched salvage tugs to the site of the casualty.
The GULF DEFFI was thereafter stabilised by the salvors and towed to a port of refuge. A ship to ship transfer took place in order to ensure that cargo could be delivered as safely and quickly as possible.
We represent part-cargo laden on board at the time of the engine room flooding and we have been actively investigating the circumstances surrounding the cause of the engine room flooding.
PANGAON EXPRESS

The PANGAON EXPRESS was proceeding on a laden voyage from Chattogram Bangladesh to Keraniganj, Bangladesh when, on or around the 6th July 2023, she partially sunk, drifted and then grounded off the coast of the Bay of Bengal.
As a result, the Owners of the PANGAON EXPRESS engaged professional salvors to render salvage assistance to the PANGAON EXPRESS and her cargo. The salvors agreed to salve the PANGAON EXPRESS and her cargo under the provisions of a fixed fee salvage contract. The salvage operation is ongoing.
The Owners of the PANGAON EXPRESS declared General Average and have appointed GA Adjusters to collect GA security.
We represent part-cargo laden on board at the time of the incident and are presently taking steps to investigate the circumstances surrounding the grounding.
NEMRUT BAY

The Bulk Carrier NEMRUT BAY ran aground in the waters off La Gi in Binh Tuan province, Vietnam on 21 June 2023. She was unable to refloat under her own power.
The Owners engaged salvors to try and refloat the vessel using several tugs. Eventually, with the assistance of a general cargo ship and four tugboats, the vessel was subsequently refloated on 13 July 2023.
Whilst the vessel was hard aground it appears that there was no significant damage to her hull and she was able to continue her voyage after inspections.
At the time of the grounding, the NEMRUT BAY was proceeding on a fully laden voyage from Korean ports to Vung Tau, Vietnam.
We represent part-cargo laden on board at the time of the incident and are presently taking steps to investigate the circumstances surrounding the grounding.
SHILING

The fully cellular containership SHILING experienced an engine failure on the 12th May 2023 off the coast of New Zealand, having just departed the port of Wellington. It would appear that the SHILING also suffered steering gear failure rendering the vessel immobilised.
As a result, the Owners of the SHILING were forced to engage salvage assistance and an anchor handling tug was despatched to the site of the casualty. The SHILING was initially taken in tow to Tasman Bay, New Zealand, where she has been anchored. The SHILING was subsequently towed back to Wellington for inspection and repairs.
Salvage services were rendered under the provision of Lloyd’s Open Form salvage contract. In addition, the Owners of the SHILING have declared General Average.
We represent part-cargo laden on board at the time of the incident and are presently taking steps to investigate the circumstances surrounding the engine failure.
NORDIC ANNA

It is reported that the 2007-built containership NORDIC ANNA experienced a fire in her engine room whilst she was berthed at the port of Gioia Tauro, Italy on 30 April 2023.
We understand that three fire-fighting tugs were deployed to extinguish the fire and that the crew, with the assistance of local firefighters, successfully extinguished the fire on 1 May 2023.
At the time of the incident, the NORDIC ANNA was proceeding on a fully laden voyage from Poti, Georgia and Asyaport, Turkey to Italian discharge ports.
As a result of the fire, The Owners of the NORDIC ANNA have declared General Average. Therefore, prior to the delivery of cargo General Average security will have to be provided.
We represent part-cargo laden on board the NORDIC ANNA at the time of the fire and therefore we are in a position to offer economies of scale in relation to any third-party investigation costs that may have to be incurred.
ESCAPE

The fully cellular containership ESCAPE experienced a fire in her engine room on the 22nd January 2023, whilst navigating the Baltic Sea. The crew were unable to extinguish the fire before they were evacuated from the vessel. Two salvage tugs, including one firefighting tug, were dispatched to the vessel in order to fight the fire. The fire aboard the ESCAPE was eventually extinguished, and the vessel was subsequently taken under tow to Riga, Latvia. At the time of the incident, the ESCAPE was proceeding on a fully laden voyage from Klaipeda, Lithuania to Riga, Latvia.
Salvage services were rendered under the provisions of Lloyd’s Open Form salvage contract. In addition, the Owners of the ESCAPE have declared General Average and have appointed GA Adjusters to collect GA security.
We are instructed to represent part-cargo laden on board the ESCAPE at the time of the incident and we are presently investigating the cause of the fire on board the ESCAPE.
UNIGLORY 2

On the 29th December 2022 the barge UNIGLORY 2 grounded heavily whilst proceeding on a laden voyage from Bintang Ninggi, Indonesia to the PT Indonesia Bulk Terminal. The UNIGLORY 2 was laden with some 7,309.00 MT of Batubara at the time of the grounding.
Despite numerous attempts to re-float, the Owners of the UNIGLORY 2 had to engage salvage assistance in order to try and re-float the UNIGLORY 2. As a result, the Owners of the UNIGLORY 2 declared General Average and appointed MCO Indonesia to collect GA security.
The UNIGLORY 2 was eventually re-floated on the 8th February 2023 and the cargo is due to be transhipped on to another barge in order for the cargo to be delivered at the original intended port of discharge.
We are instructed to represent the entirety of the cargo laden on board the UNIGLORY 2 at the time of the grounding. We are presently investigating the cause of the grounding and further we are advising on the provision of GA security, once the cargo is safely on its way to the original intended destination.
2022
GREEN SELJE

On 1st December 2022, whilst proceeding on a fully laden voyage from the Faroe Islands to West Africa, the reefer vessel GREEN SELJE suffered a catastrophic rudder loss which rendered her immobilised.
As a result of the rudder loss, the Owners of the GREEN SELJE arranged for salvage services to be rendered to the GREEN SEJLE and she was towed to Vigo, Spain where she is due to undergo repairs. The cargo will be transhipped on to another vessel in order for the intended voyage to be completed.
The Owners of the GREEN SEJLE declared General Average and have appointed Richard Hoggs Lindley to collect GA security.
We are instructed to represent the entirety of the cargo laden on board the GREEN SELJE at the time of the incident. We are actively investigating the circumstances surrounding the rudder loss and have been successful in placing an H&M expert on board the GREEN SEJLE to investigate causation.
QING LI

The Bulk Carrier QING LI suffered a fire in her cargo hold on the 25th November 2022 just prior to discharge of cargo at the port of Nagoya, Japan.
As a result of the fire, the QING LI was forced to move to the outer-anchorage whilst the fire was extinguished. The Owners of the QING LI declared General Average and have appointed Chinese GA Adjusters to collect GA security.
At the time of the incident the QING LI was proceeding on a laden voyage from Vladivostok, Russia to Nagoya Japan.
We are instructed to represent all cargo on board the QING LI at the time of the fire and are presently investigating the cause of the fire on board the vessel.

The Bulk Carrier HAU SHUN DA 3 suffered a main engine breakdown on the 3rd November 2022 whilst sailing off the coast of China.
As a result of the main engine breakdown, the Owners of the HUA SHUN DA 3 were forced to engage salvage assistance and the vessel was take in tow to the Shidao Anchorage, China. At the time of the incident the HUA SHUN DA 3 was proceeding on a fully laden voyage, loaded with some 2,605 MT of Kaolin in bulk, from China to Japan.
The Owners declared General Average and appointed Chinese GA Adjusters to collect GA security.
We are instructed to represent all the cargo on board the HUA SHUN DA 3 at the time of the incident and we are presently investigating the cause of the main engine breakdown in order to establish causation.

As a result of the shift of cargo, that stability of the ST COLUMBA was compromised and the Owners of the ST COLUMBA decided to deviate to Busan, Korea for inspections and necessary repairs to be undertaken.
The Owners of the ST COLUMBA subsequently declared General Average and appointed Richards Hogg Lindley to collect GA security.
We represent part-cargo laden on board the ST COLUMBA and we are presently investigating the cause of the shift of cargo in order to investigate causation.

The fully cellular containership ZIM CHARLESTON suffered a fire in her cargo hold on the 8th August 2022 shortly after departure from Colombo, Sri Lanka. As a result of the fire, the ZIM CHARLESTON was forced to return to Colombo in order to discharge fire damaged containers and to ascertain the extent of damage to cargo and vessel.
At the time of the incident, the ZIM CHARLESTON was proceeding on a fully laden rotational voyage from Chinese load ports, South Korea, Hong Kong, Singapore and Sri Lanka to ports in India.
As a result of the fire, the Owners of the ZIM CHARLESTON have declared General Average and have appointed GA Adjusters to collect GA security.
We are instructed to represent part cargo laden on board the ZIM CHARLESTON at the time of the incident and we have retained experts and are investigating the cause of the fire in order to determine causation.
BAO QUAN

On the 14th July 2022 the BAO QUAN suffered a machinery failure in heavy weather off the coast of Pakistan. At the time of the incident the BAO QUAN was laden with approximately 40,000 metric tonnes of steel that had been loaded at various Chinese ports destined for discharge in the United Arab Emirates.
As a result of the machinery failure, the BAO QUAN was forced to divert to Gwadar port, Pakistan, as a port of refuge. The BAO QUAN underwent repairs and is now proceeding to her original intended discharge ports in the UAE.
The Owners of the BAO QUAN have declared General Average and have appointed Chinese GA Adjusters to collect GA security.
We are instructed to represent part cargo laden on board the BAO QUAN at the time of the incident and we are actively investigating the circumstances surrounding the machinery failure in order to determine causation.

On 29 June 2022, the BBC ARKHANGELSK grounded off Montreal, Canada on 29 June 2022 whilst traveling from Santos, Brazil to Oswego, USA. The Shipowners declared General Average following the grounding.
The vessel received temporary repairs at Montreal and then continued her voyage to Oswego where she delivered her cargo.

On 6 June 2022, the ROYAL II suffered main engine failure in the Red Sea whilst en route from Zhangjiagang, China to Rotterdam, Netherlands. General Average was then declared by the bareboat charterers of the vessel, Rongtai (HK) Holding Limited.
The vessel received repairs in Jeddah and is currently enroute to Cuxhaven, Germany where, as a result of port congestion at Rotterdam, the Rotterdam bound cargo will be discharged and carried via barges to Rotterdam.
We are instructed to represent part cargo laden on board the ROYAL II at the time of the casualty and are investigating the circumstances leading up to this casualty in order to determine its cause, with a view to assessing whether GA is payable by our clients and/or whether cargo losses are recoverable.

On 14 April 2022, the inbound product tanker vessel ORION EXPRESS came in contact with the outbound general cargo container-carrier HAIAN CITY at Chittagong, Bangladesh. The HAIAN CITY was sailing from Chittagong to Singapore at the time and suffered damage as a result of the collision.
The shipowners declared General Average on 28 April 2022 after the vessel berthed at Chittagong’s Karnafuli Drydock for repairs. It is understood that some containers have been taken off the vessel to allow for the repairs and that all undamaged containers will be reloaded for delivery after the repairs have been completed.
We are instructed to represent part cargo laden on board the HAIAN CITY at the time of the casualty and are investigating the circumstances leading up to this casualty in order to determine its cause, with a view to assessing whether GA is payable by our clients and/or whether cargo losses are recoverable.

As a result, the vessel became partly submerged and a number of containers of cargo have been submerged and are likely to be a total loss.
The Owners of the MARINTRUST – 1 have declared General Average and have appointed Marine Claims office of Asia as the GA Adjusters. We are in correspondence with the GA Adjusters and are presently negotiating more favourable GA security wording on behalf of cargo interests we represent.
We are instructed to represent a significant volume of cargo laden on board the MARINTRUST – 1 at the time of the incident and we are actively investigating the circumstances surrounding the capsizing in order to determine causation.

The fully cellular containership EVER FORWARD ran aground in Chesapeake Bay on the 13th March 2022. At the time of the incident, the EVER FORWARD was proceeding on a fully laden voyage from Xiamen, Hong Kong and Yantian, China to Baltimore, Norfolk and New York, USA.
Despite numerous attempts to re-float the EVER FORWARD over the past couple of weeks, she remains hard aground and it is likely that a lightering operation will be required in order to successfully re-float the EVER FORWARD.
As a result of the grounding, the Owners of the EVER FORWARD have declared General Average and have appointed Richards Hogg Lindley as the GA Adjusters. We are in correspondence with the GA Adjusters and are presently negotiating more favourable GA security wording on behalf of cargo interests we represent.

As a result of the grounding, salvage services were rendered to the KAPITAN SHYRIAGIN under the provisions of Turkish Open Form dated 11 March 2022. The KAPITAN SHYRIAGIN was successfully re-floated and thereafter continued on her original voyage.
The Owners of the KAPITAN SHYRIAGIN declared General Average and appointed GA Adjusters to collect GA security and thereafter draw up the GA Adjustment. We are instructed to represent cargo interests laden on board the KAPITAN SHYRIAGIN at the time of the casualty.

As a result of the main engine breakdown, the vessel returned to Singapore where, following on from advices from the Class surveyor, the LOTSTELLA will enter dry dock in order to effect permanent repairs. Cargo will be have to be transhipped on to another vessel in order to complete the original intended voyage.
The Owners of the LOTSTELLA declared General Average and we are instructed to represent cargo interests in relation to the claims arising as a result of this casualty.

In December 2021 the FRIJSENBORG loaded a cargo of fireworks at the port of Beihai, China and a cargo of steel at Sattahip, Thailand and Yokohama, Japan destined for Galveston and Houston.
On the 24th December 2021 she suffered a significant fire in her engine room whilst some 450 nautical miles southwest of Baja California Sur State coast, Mexico. The fire was extinguished by the crew but the vessel was rendered immobilised. Therefore, Owners of the FRIJSENBORG engaged professional salvors Smit to render salvage assistance under the provisions of Lloyd’s Open Form salvage contract (LOF). The salvors despatched the salvage tug DREW FOSS which sailed from San Diego and took the vessel in tow on the 30th December 2021.
The convoy arrived safely at the port of Balboa, Panama where the salvage services terminated and the vessel was redelivered to her Owners. In addition to the LOF salvage claim, the Owners of the FRIJSENBORG declared General Average and appointed GA Adjusters to collect GA security.
We are instructed to represent part cargo laden on board the FRIJSENBORG at the time of the incident and we are actively investigating the circumstances surrounding the cause of the engine room fire which has given rise to the LOF salvage claim and the GA claim.

The general cargo container-carrier ALION departed Mumbai, India destined for Fujairah, UAE. Having loaded cargo at Fujairah she thereafter departed Fujairah destined for Mombasa, Kenya when she suffered an engine failure in the Arabian Sea. Due to very poor weather conditions, the Owners of the ALION were forced to seek professional salvage assistance under Lloyd’s Open Form with Tsavliris Salvage International. She was then towed to Sharjah, UAE.
We understand that the ALION will receive permanent repairs in the first week of November 2021 and then continue her voyage.
As a result of this casualty, the owners of the ALION declared General Average (GA) and appointed Hellenic Marine Adjusters S.A. as their GA Adjusters. We are instructed to represent cargo interests and shall look into investigating the circumstances leading up to this casualty in order to determine causation, with a view to assessing whether GA is payable by our clients or not.

At the time of the fire, the NYK DELPHINUS was located some 50 nautical miles off Monterey, California. As a result of the fire the NYK DELPHINUS was immobilised and her Owners had to engage salvage assistance. The NYK DELPHINUS was towed to the port of Oakland, California, for inspection. At the present time, the NYK DELPHINUS remains berthed at the port of Oakland.
The Owners of the NYK DELPHINUS have declared General Average and have appointed Marine Adjusting Solutions as the GA Adjusters. The general cargo container-carrier EEMSLIFT HENDRIKA was travelling from Bremerhaven (Germany) to Ulsteinvik (Norway) when she suffered from instability and water intake after encountering bad weather and the shifting of cargo in the North Sea, near the Ålesund offshore area. Attempts were made to stabilise the vessel, however, the crew were eventually forced to abandon the Vessel as there was a risk that the Vessel might capsize.
Salvors (SMIT Salvage B.V.) were appointed under LOF terms and the Vessel was towed to Ålesund and berthed.
As a result of this casualty, the owners of the EEMSLIFT HENDRIKA declared General Average (GA) and appointed A.C.G. Schoutens as their GA Adjusters. We are instructed to represent cargo interests whose heavy marine equipment was on board at the time of the casualty and we are actively investigating the circumstances leading up to this casualty in order to determine causation, with a view to establishing whether GA is payable by our clients or not.

The fully cellular ultra large container-carrier EVER GIVEN ran aground in the Suez Canal on the 23rd March 2021. At the time of the incident, the EVER GIVEN was proceeding on a fully laden voyage from Asian load ports to European discharge ports. It is thought that at the time of the grounding she was nearly full to capacity laden with 20,000 sea containers.
As a result of the grounding, the Owners had to engage salvage assistance and on the 29th March she was successfully re-floated. We understand that some 13 salvage tugs were engaged in the operation to free and re-float the EVER GIVEN. Following on from the successful re-floating operation, the EVER GIVEN was towed to Bitter Lakes where she is presently undergoing underwater dive surveys and structural surveys in order to ensure the integrity of the hull.
The Owners of the EVER GIVEN have declared General Average and have appointed Richards Hogg Lindley as the GA Adjusters. We are instructed to represent a significant volume of cargo laden on board the EVER GIVEN at the time of the incident and we are actively investigating the circumstances leading up to the grounding in order to determine causation.

Roose + Partners is representing cargo insurers following a significant loss of containers from the “ONE APUS” north of Hawaii on 30 November 2020. The Japanese flagged vessel is reported to have lost approximately 1,912 containers when the stacks collapsed and lashing systems failed during heavy weather. This follows a series of other container loss incidents, including the “MSC ZOE” and “MAERSK ESSEN” in a climate where the sheer size of container ships continues to make headlines. Larger vessels have shown a greater tendency to be affected by parametric rolling in certain sea conditions, which places excessive forces on the vessel’s structure and container securing system.
Large numbers of containers from “ONE APUS” were also found to be damaged following careful dismantling of the stacks at the Port of Kobe. The vessel eventually resumed her voyage to Long Beach, California, where she arrived in April 2021. Many of the damaged containers were transloaded, eventually arriving on other services.
To date, GA has not been declared.
Investigations are ongoing into the loading software, passage planning and the actions of the crew to negate the forces acting to the vessel during heavy weather.
